Terms & Conditions

By submitting a service request for a DIY360 Virtual Tour, you acknowledge that you understand and agree to the following Terms and Conditions.

SCOPE OF WORK

The STUDIO (Point of View Concepts – POVC360) agrees to produce virtual tours to the best of their abilities in accordance with the services and options selected. Every effort will be made to assure CLIENT satisfaction according to industry and intracompany standards.

For each Virtual Tour Request submitted by CLIENT, STUDIO will deliver a final Virtual Tour to CLIENT.

Any optional or custom services requested by the CLIENT will be detailed in a separate Agreement.

CLIENT agrees to submit their specialized 360 Panorama photography files to the STUDIO as directed through the DIY360 Training or by STUDIO’s direction. 

Maximum Panoramas for Virtual Tour:
Contact us for specific details. Based on type of Virtual Tour you choose, a maximum number of panoramas/views per unit are included in the final tour navigation.

More than the maximum number of images may be submitted to us without additional cost, but no more than the maximum final panoramas can be used to create the tour without additional cost. STUDIO will confirm with CLIENT before going beyond the maximum number of panorama images required to create their purchased version of a Virtual Tour. Images (either requested or necessary) in excess of these limits will be billed additionally at $20 per image/panorama. STUDIO does their best to use the minimal number of panoramas while still providing a user-friendly Virtual Tour experience.

DELIVERY

Virtual Tour turnaround time is typically within 72 hours if order is placed Monday – Thursday. Allow additional time if submitted Friday – Sunday, afterhours or during holidays. Delivery timeframe starts from the date all CLIENT information; files and payment have been received, and based on STUDIO’s available production schedule.

When a Virtual Tour is completed, CLIENT will receive an email containing file/ss and link/s to their completed Virtual Tour.  

SERVICE TERMS

Copyrights. CLIENT owns copyrights to their submitted photos and agrees to license the photos to the STUDIO for the creation of the Virtual Tour. Furthermore, CLIENT acknowledges that STUDIO owns copyrights to the published Virtual Tour but not the photographs.

Virtual Tour Hosting. After 12 months CLIENT can continue to host with STUDIO at a nominal charge per year, ask STUDIO to remove the files from our server, or CLIENT can opt to self-host the files on their own server. In the case of Self-hosting, the STUDIO agrees to license hosted Virtual Tour files to CLIENT in perpetuity.

Payments. Payment for Virtual Tour orders must be paid in full at time of ordering, or monthly Volume clients must be setup on pre-approved invoicing before any services are rendered. Your account and payments must be current to submit a Virtual Tour Request for processing.

Refunds. If CLIENT cancels a Virtual Tour after submitting a request, if work has not yet begun on the project, the STUDIO will issue an account credit that the CLIENT can use on a future Virtual Tour.

Cancellation
For “Get It All” Virtual Tour Packages – Equipment that has already been shipped to CLIENT or CLIENT”s company cannot be canceled. Contact us for details.

INDEMNIFICATION

STUDIO will retain necessary CLIENT files for 12 months after original order submission. STUDIO will take reasonable steps to prevent data loss during that time but is not liable for loss of data due to technical failure. After this period has expired, STUDIO has no duty to retain files.

If STUDIO is unable to perform the services in this agreement due to any cause outside its control, such as fire, flood, casualty, act of God or terrorism, illness, or any other reasonable cause outside the STUDIO’s control or expectation, CLIENT agrees to indemnify STUDIO for any loss damage or liability; however, STUDIO will return in full the payment made by CLIENT in relation to the specifically impacted Virtual Tour project.

CLIENT agrees to hold STUDIO harmless for all content, uses, uploads, and showings of virtual tour after completion.

ARBITRATION

In the event that STUDIO must pursue legal action in order to collect on balances due, CLIENT agrees to reimburse STUDIO for all expenses incurred to recover any and all sums due, including but not limited to all attorney’s fees, losses, and other expenses, and to be settled in a court or arbitration in the state of Florida, in Highlands County.
